The maximum segment Size (MSS) defines the maximum number of Oktetts, which can be dispatched as utilizable data in a TCP segment. During the connection establishment the two receiving stations agree on the smaller two MSS values. Since with IPv4 of the IP and TCP headers together at least 40 of Oktetts is large, the MSS must be smaller there around at least 40 of Oktetts than the maximum transfer unit (MTU), in order to avoid a fragmenting of the IP packages.
